Grounded in the vision of equality enshrined in the charter of the United Nations, UN Women works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian actions and peace and security. Placing women’s rights at the center of all its efforts, United Nations Entity for Gender Equality and the Empowerment of Women (UN Women) will lead and coordinate United Nations system efforts to ensure that commitments on gender equality and gender mainstreaming translate into action throughout the world. It provides strong and coherent leadership in support of national priorities and efforts, building effective partnership with government, civil society and other relevant actors.
Established by General Assembly resolution 64/289 of 2 July 2010 on system-wide coherence, with a mandate to assist Member States and the United Nations system to progress more effectively and efficiently towards the goal of achieving gender equality, women’s empowerment, and upholding women’s rights, UN Women’s global programmatic priorities for the period 2014-2017 are: (a) women lead and participate in decision making at all levels; (b) women, especially the poorest and most excluded, are economically empowered and benefit from development; (c) women and girls live a life free from violence; (d) peace and security and humanitarian action are shaped by women’s leadership and participation; (e) governance and national planning fully reflect accountability for gender equality commitments and priorities; and (f) a comprehensive and dynamic set of global norms, policies and standards on gender equality and women’s empowerment is in place and is applied through action by Governments and other stakeholders at all levels.
Nepal promulgated the new Constitution of Nepal on 20 September 2015, which is the seventh constitution in the constitutional history of the country and the first to have been promulgated from the Constituent Assembly through public consultation. There are many positive provisions in the new constitution that seek to progress gender equality and women’s empowerment. The promulgation of new constitution has opened avenues for broader legal reform, since implementation of the fundamental rights guaranteed by the new constitution can take momentum only after they are translated into the legal framework. Recent years have witnessed progress in legislations on gender equality laws such as: a 5-year National Strategy and Plan of Action on Gender Empowerment and for Ending Gender Based Violence (2012/13 -2016/17) have been put in place along with other major programme documents- the Beijing Platform for Action (BPfA). The other legal frameworks include the Act to Amend Some Nepal Acts for Establishing Gender Equality and Eliminating Gender Based Violence 2015, the Anti-Witchcraft Act 2015, the Domestic Violence (Crime and Punishment) Act 2009, the Human Trafficking and Transportation (Control) Act 2007, which have been adopted in helping the survivors to access justice, security, psycho- social care and possible livelihood opportunities. The Government of Nepal broadly acknowledges the need for monitoring mechanism to monitor the implementation status of existing laws, policy framework and national plan of actions. For this, it has developed various executive, legislative oversight measures for tracking & monitoring the progress on the implementation status of any laws, policies and plans including the DV Act, 2009 and Rules 2010.
The Domestic Violence (Crime and Punishment) Act- 2009 and Domestic Violence (Crime and Punishment) Regulation- 2010 gives comprehensive and effective civil remedies with criminal procedures to ensure effective protection and relief to the victims of domestic violence. However, the monitoring of the implementation of such a law remains poor. Hence it is necessary to monitor the Ending Gender Based Violence (EVAW) laws including the Domestic Violence (Crime and Punishment) Act- 2009 and Domestic Violence (Crime and Punishment) Regulation- 2010 regularly for its effectiveness and to help in setting precedents and standards. Monitoring implementation of the Domestic Violence (Crime and Punishment) Act- 2009 and Domestic Violence (Crime and Punishment) Regulation- 2010 is an important component of the government entities mandated to oversee the implementation of the law.
In this context, Ministry of Women Children and Social Welfare (MoWCSW) is committed to bring out a comprehensive report to be launched during the sixteen days’ activism period covering the twenty districts. The MoWCSW has shared the monitoring framework with twenty districts as of now. The report of the twenty districts will serve as a baseline for covering all districts in second phase.
UN Women provided technical and financial support to the MoWCSW to develop a monitoring framework for the implementation of the Domestic Violence (Crime and Punishment) Act- 2009 and Domestic Violence (Crime and Punishment) Regulation- 2010. The monitoring framework has been endorsed by the MoWCSW and the monitoring framework, will enable the ministries to generate information’s on the implementation of Domestic Violence Law and Regulation and make further recommendation for its effective implementation. In line with this, the MoWCSW has further requested UN Women to provide technical support to consolidate and draft a comprehensive report to the MoWCSW to track Domestic Violence Law and Regulation using the monitoring framework.

Duties and Responsibilities

The overall objective of the assignment is to provide support to the MoWCSW to consolidate and draft a comprehensive report on the implementation of the Domestic Violence Law and Regulation in twenty-two districts using the monitoring framework.
To achieve the above mentioned specific objectives, the consultant is expected to carry out the below activities under the leadership of the MoWCSW and UN Women:
• Develop and consolidate a comprehensive report using the monitoring framework to identify and analyse the implementation of the domestic violence laws in twenty districts;
• Develop a matrix detailing government agencies collecting data on crime against women and girls.

Methodology:

• Meeting with the MoWCSW, Department of Women and Children during the preparation of the report.

Reporting requirement:

The selected consultant will report to the Programem Officer for EVAW, UN Women on a regular basis to update the progress towards achieving the deliverables and will work closely with Joint Secretary of the MoWCSW. The other reporting requirement is given below:
• The consultant will submit inception report incorporating a workplan and methodology to support the implementation of this assignment;
• The consultant will submit progress update report to UN Women monthly basis;
• Final comprehensive report using the monitoring framework;
• Powerpoint presentation covering the summary of the report.

Key Deliverables:

• First draft inception report including conceptual framework, methodology and detailed workplan;
• Final comprehensive report using the monitoring framework to identify and analyse the implementation of the domestic violence laws in twenty districts;
• Matrix detailing crime against women and girls.
The payment schedule for the consultant will be as follows:
• Upon submission of detailed work plan and approval of UN Women- 20% of total contract amount;
• Upon completion and approval of all deliverables by UN Women – 80% of the total contract.

Required Skills and Experience

Education

• Master’s degree in law or equivalent, preferably with a focus on gender, human rights, and justice.

Experience

• A minimum of 7 years’ experience in the legal or justice sector;
• Proven experience in coordinating review of the existing legislation and conducting desk review/ research, legal analysis, and legal drafting;
• Technical expertise in women’s human rights and endign violence against women;
• A strong understanding of the judicial system in Nepal;
• Proven expertise on federal governance system;
• A strong record in designing and leading legal study.

Language

• Excellent command of written and oral English.
